Terms of Service

By signing up for or using OffsiteAI ("the Service"), you agree to these Terms of Service. If you don't agree, don't use the Service.

1. Who We Are

OffsiteAI provides AI-powered chatbot and CRM software to contractors and small businesses. The Service is operated by OffsiteAI, contactable at ben@offsiteai.io.

2. Account Eligibility

You must be at least 18 years old and authorized to bind your business to these terms. You're responsible for keeping your account credentials secure.

3. Subscription & Payment

OffsiteAI is offered on a monthly subscription. Plans and pricing are listed at offsiteai.io/#pricing.
Payment is processed via Stripe and charged at the start of each billing period.
You can cancel anytime from the CRM Settings page or by emailing ben@offsiteai.io.
Cancellation takes effect at the end of your current billing period — no partial refunds for unused time, but you can keep using the Service until then.
Free trials (when offered): no charge during trial. If you don't cancel before trial ends, you're charged for the next month.

4. Acceptable Use

You agree NOT to use OffsiteAI to:

Send spam, unsolicited messages, or anything that violates the TCPA or CAN-SPAM Act.
Impersonate other businesses or individuals.
Collect data from people who haven't consented (your customers must knowingly engage with the chatbot).
Scrape, reverse-engineer, or attempt to reverse-engineer the Service.
Resell OffsiteAI as your own product without written permission.
Run illegal businesses, gambling, adult content, or any business that violates local laws.

We reserve the right to suspend or terminate accounts that violate these terms.

5. Your Content & Data

You own your data — contacts, deals, conversations, etc. We just store it for you. By using OffsiteAI, you grant us a limited license to process your data only as needed to provide the Service.

You're responsible for the accuracy of your business info (services, pricing, hours). The chatbot only quotes what you tell it.

6. AI Disclaimer

AI-generated estimates are approximate ballpark ranges only. They are not formal quotes, bids, or binding commitments. Final pricing must be confirmed through an in-person consultation or written quote from your business.

OffsiteAI uses AI (Claude by Anthropic) to power chatbot responses. While we work hard to keep the AI accurate and aligned, AI can occasionally make mistakes. You agree to:

Review chatbot conversations regularly.
Not solely rely on AI-generated quotes as legally binding contracts.
Always confirm major commitments (large quotes, scheduling) with the customer directly.

OffsiteAI is not liable for inaccurate quotes, mis-scheduled appointments, or any business decisions made based on AI output. Use the AI as a tool, not as a replacement for your judgment.

7. Service Availability

We work to keep OffsiteAI available 24/7 (see our status page) but we can't guarantee 100% uptime. We're not liable for downtime, lost leads during outages, or other indirect damages — though we'll always try to make outages right.

8. Privacy

Our use of your data is governed by our Privacy Policy. By using the Service you agree to that policy.

9. Cancellation & Termination

You can cancel anytime — no questions asked.
We can terminate accounts that violate these terms or that are inactive for more than 12 months after cancellation.
On cancellation, you can export your data for 90 days. After that it's permanently deleted.

10. Limitation of Liability

To the maximum extent allowed by law, OffsiteAI is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, customers, or business opportunities. Our total liability for any claim is limited to the amount you paid OffsiteAI in the 3 months prior to the claim.

11. Indemnification

You agree to indemnify and hold harmless OffsiteAI from any claims, damages, or expenses arising from:

Inaccurate business information you provided.
Your own services, products, or customer interactions.
Any dispute between you and your customers.

12. Changes to Terms

We may update these terms periodically. Material changes will be announced via email at least 30 days in advance. Continued use after changes means you accept them.

13. Governing Law

These terms are governed by the laws of the State of Arizona, United States. Any disputes will be resolved in Maricopa County, Arizona courts.
